End-User License Agreement
This End-User License Agreement ("EULA") is a legal agreement between you ("Licensee") and The Truly Perfect LLC (Texas limited liability company) ("Licensor"), operator of The Perfect Start application ("App"). By downloading, installing, or using the App, you agree to this EULA. If you do not agree, do not use the App.
This EULA supplements our Terms of Service and Privacy Policy, which are incorporated by reference. In the event of a conflict, the Terms of Service govern.
1. License Grant
Subject to the terms of this EULA and your compliance with it, the Licensor grants you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on iOS devices that you own or control
- Use the App for your personal, non-commercial purposes — specifically for tracking your postpartum recovery and your baby's care
This license does not include any right to sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App.
2. License Restrictions
You may not:
- Copy, modify, adapt, translate, or create derivative works of the App
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
- Remove, obscure, or alter any copyright, trademark, or other proprietary notice within the App
- Redistribute, sell, rent, lease, lend, or sublicense the App to any third party
- Use the App for any commercial purpose without prior written consent from the Licensor
- Use the App in any manner that violates applicable law
- Circumvent any license key, authentication, or access control mechanism in the App
3. Ownership
The App, including its design, source code, content, branding ("The Perfect Start," "The Truly Perfect Start"), AI system architecture, and all other materials provided by the Licensor, is and remains the exclusive property of The Truly Perfect LLC and is protected by intellectual property laws including copyright and trademark laws.
This EULA does not transfer any ownership interest to you. You receive only the limited license described in Section 1.
4. User Content License
You retain ownership of all data and content you enter into the App (your baby logs, health records, messages, and notes). By using the App, you grant the Licensor a limited, non-exclusive, revocable license to store, display, and process your content solely for the purpose of operating the App and providing its features to you.
This license is immediately revoked upon account deletion. The Licensor will delete your content as described in the Privacy Policy.
5. Open-Source Components
The App is built using open-source software components, including React, Capacitor, and other libraries. These components are used under their respective open-source licenses (MIT, Apache 2.0, and others). Your use of the App does not grant you any rights to those open-source components beyond what their respective licenses provide.
6. Updates and Changes
The Licensor may, from time to time, release updates to the App. Updates may be delivered automatically via the App Store. This EULA applies to all updates, upgrades, and new versions of the App unless a separate license is provided with the update.
We reserve the right to modify or discontinue the App at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.
7. Termination
This EULA is effective until terminated. Your rights under this EULA terminate automatically without notice if you fail to comply with any of its terms. Upon termination:
- You must stop using the App and delete all copies
- All licenses granted to you under this EULA will cease
- Provisions that by their nature survive termination (ownership, warranty disclaimers, limitation of liability, governing law) will survive
You may also terminate by deleting your account and uninstalling the App.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
The Licensor does not warrant that the App will meet your requirements, operate uninterrupted or error-free, or that defects will be corrected. See our Terms of Service for the full warranty disclaimer.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.

10. Governing Law
This EULA shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from this EULA are subject to the arbitration and governing law provisions in our Terms of Service.
11. Apple EULA Requirements
The following provisions apply specifically to the iOS version of The Perfect Start, distributed through the Apple App Store:
Licensor: The Truly Perfect LLC (the developer and operator of The Perfect Start)
Licensee: You, the end user
Apple is not a party to this EULA and is not responsible for The Perfect Start or its content. Apple has no obligation to provide maintenance or support for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to failure to conform to any warranty are the Licensor's sole responsibility.
The Licensor, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your use of the App, including product liability claims, consumer protection claims, and intellectual property infringement claims.
You represent and warrant that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and are not on any US government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, Apple will have the right to enforce this EULA against you as a third-party beneficiary.
The App Store Terms of Service are incorporated into this EULA by reference. In the event of conflict between this EULA and the App Store Terms of Service, the App Store Terms of Service shall control with respect to Apple's rights and obligations.
